Introduction
Welcome to KIN, a word puzzle game developed by Garrett Smallwood. These Terms of Service ("Terms") govern your use of the KIN app on iOS and through web browsers (the "App"). By downloading, installing, or using KIN, you agree to these Terms. If you don't agree, please don't use the App.
License and Permitted Use
We grant you a limited, non-exclusive, non-transferable license to use KIN for personal, non-commercial purposes. You may not:
- Reverse engineer, decompile, or attempt to extract the App's source code
- Scrape, extract, or automatically download puzzle content
- Use bots, scripts, or automation tools to play puzzles or manipulate gameplay
- Share your account with others or sell your account to third parties
- Remove or alter any copyright, trademark, or proprietary notices
KIN+ Subscription
Free Tier: You have permanent access to one daily KIN puzzle at no cost.
KIN+ Subscription: KIN+ provides access to unlimited themed puzzle packs and premium features. Pricing is $2.99/month or $19.99/year.
Auto-Renewal and Payment Disclosure
Your subscription will automatically renew at the end of each period unless you cancel at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours before the end of the current period.
You can manage and cancel subscriptions in your App Store account settings at any time. Cancellation will take effect at the end of your current billing period.
Payment and Billing: All payments are processed through Apple's in-app purchase system. Apple may charge your Apple ID account for subscription renewals. By purchasing KIN+, you authorize Apple to charge the subscription price to your account on a recurring basis until you cancel.
Restore Purchases
If you reinstall the App or switch devices, you can restore your KIN+ subscription through the App Store account settings. This will verify your active subscription without requiring a new purchase.
Intellectual Property
App Content: All puzzles, game mechanics, designs, and content in KIN are owned by us and protected by copyright. You may not reproduce, modify, or distribute them without permission.
User Content: Any share cards or gameplay summaries you create remain your own. By sharing them, you grant KIN a non-exclusive, royalty-free license to display them within the App and on social media (if applicable).
User Conduct
You agree not to:
- Harass, abuse, or threaten other users
- Post illegal, obscene, or defamatory content
- Attempt to gain unauthorized access to the App or its systems
- Interfere with or disrupt the App's functionality or servers
- Use the App for any illegal purpose
We reserve the right to suspend or terminate your account if you violate these terms.
Disclaimers
KIN is provided "as is" without warranties of any kind. We do not guarantee that the App will be error-free, uninterrupted, or meet your specific needs. Your use of KIN is at your own risk.
No Warranty: We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of KIN, even if we've been advised of the possibility of such damages.
Our total liability to you for any claim related to KIN is limited to the amount you've paid us through subscription or in-app purchases in the 12 months preceding the claim.
Changes to Terms
We may update these Terms from time to time. We'll notify you of material changes via email or through an in-app notice at least 30 days before the change takes effect. Your continued use of KIN after changes means you accept the updated Terms.
Termination
We may suspend or terminate your account if you violate these Terms or engage in illegal activity. Termination is effective immediately. Upon termination, your right to use KIN ends, though you may be entitled to a refund of prepaid subscription fees according to applicable law.
Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws principles. Any dispute arising from these Terms or your use of KIN will be resolved in the state or federal courts located in Florida.
Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it valid, and the remaining provisions will continue in full effect.
